Ok, so it may be wishful thinking, but on the 103rd time I watched Dr. Horrible something finally struck me like a lightening bolt, a way that Penny MAY be able to come back.
What if Penny is the blog emailer "dead not sleeping" that Dr. Horrible reads from right before the first song? Hear me out. Wouldn't it be just like a girl who may be mildly interested in a guy to ask about what "HER" he keeps mentioning in his blog, the writer has to be female even if not Penny. Now, following the laundromat scene where Billy-Buddy mentions wanting a job Penny breaks into song and sings about (paraphrasing -I know shame on me for not having every word memorized yet) "even in the darkness there are colors all around" and "even the rain can be felt deep underground." So, what if part of Penny's tortured soul and the ability to have such a seemingly naive outlook is that she is already dead?
Watch her death scene again too, especially when she is put on the stretcher. She's dead, but someone who didn't know better might think she was sleeping. Plus, while within the realm of real reactions to dying, her unconcern about her death could be another clue.
What's anyone else think?

It's a great theory, but her apparent lack of concern about her death is most likely because she didn't realize she was dying, not because she was already dead. If she was dead already, why would she be doing laundry and changing outfits? How could Hammer not have noticed she was cold to the touch?
If Penny watched his vlog, she would certainly know that Billy = Dr. Horrible and not be surprised at all when DH sings "head up, Billy buddy, there's no time for mercy". And she wouldn't be innocently introducing CH to DH. And I somehow really doubt she'd like DH very much, as much as it's clear she likes Billy. The lyrics actually are: "even in the darkness, every color can be found" and "every drop of rain will keep you growing seeds you're sowing in the ground" or "every day of rain brings water flowing to things growing in the ground"

Is that to say that misery (rain) is what's needed to reach your ambitions (seeds you're sowing) or to help others less fortunate (things growing in the ground)?

I think you're guilty of wishful thinking here. Not that I don't appreciate your creative thinking.
But Dr. Horrrible had to commit a murder in order to get into The Evil League of Evil, and given the seemingly astute intelligence resources of the league, they would have known if the murder was real, or just a hoax to get Billy into the League. Not to mention the number it does on Hammer. No, she's dead in my book. However, we're talking about DOCTOR Horrible here. Joss & team could try a spin on Frankenstein (after all he has the right labcoat and try to ressurrect her? Just a thought.

I thought its pretty obvious how Penny can come back. I mean what is to stop Dr. Horrible from building a "life ray"

Here's another thought: Who's doing this?
Do you really think that they wouldn't turn this into some Horrible "Monkey's Paw" incident? (Isn't that what DHSB was in each episode?)
Then again, I wouldn't mind seeing Felicia Day as a different Penny.
Still, I think Penny's Song was rather prophetic. He got everything he ever through what I'd call a huge drop of rain.

Want to make it clear, I said how they could bring Penny back. Not that they should or that it would be a good idea.
I quite liked the ending and in fact I'm a little worried that its going to be ruined now with overhype on the 4th act.

I actually find it very irritating that so many movies and TV shows regularly bring people back from the dead. It's almost impossible to get a true emotional response to a dramatic death any more since everyone's thinking, well, maybe they'll resurrect her, or this will turn out to be a dream, or they'll rewind time and the second time it won't happen etc.
I'd like to see more series have an explicit "nobody comes back" policy.

Actually, I really am fine with Penny being dead, despite starting this thread. I see the whole comic-book stereo-type of tragic death that the hero-to-be could have stopped but didn't because of apathy. Ex: Peter Parker didn't realize the burglar he let go would end up killing his Uncle. So, because of that he became a hero. I understand a similar need for Dr. Horrible to experience tragedy to fully embrace his powers, good or evil.
The wishful thinking is not so much that I want Penny back, but that I want Felicia Day back
And, like I said, I was just listening to the lyrics and it jolted something that made me think. Those words came from somewhere, and I think there is something beyond symbolism in them as Joss tends to intertwine simple real meanings with more complex stuff.
As for bringing back from the dead or the character being dead and still needing to do laundry, need I remind anyone that at least 50% of the characters in Buffy and Angel were dead and that they needed clothes that didn't smell like a grave?
